Tornado Cash Sanctions Removed

A court in the US state of Texas took a critical step for crypto privacy technologies by lifting the sanctions imposed by the US Treasury Department's Office of Foreign Assets Control (OFAC) against Tornado Cash.

This decision is considered a harbinger of more innovation-friendly regulations for the future of both blockchain and privacy-oriented technologies.

OFAC blacklisted Tornado Cash in August 2022. Tornado Cash is known as a “mixing” protocol that increases the privacy of crypto assets.

OFAC claimed that the North Korea-linked Lazarus Group laundered over $455 million in stolen digital assets using this protocol. Following these sanctions, Tornado Cash developer Alexey Pertsev was arrested on charges of money laundering.

The Netherlands’ s-Hertogenbosch Court of Appeal sentenced Pertsev to 5 years and 4 months in prison in May 2024. Pertsev was accused of facilitating the illegal flow of $1.2 billion in funds through Tornado Cash. However, the Texas court’s decision did not change Pertsev’s legal situation.

According to the court file published on January 21, 2025, the US District Court for the Western District of Texas revoked OFAC sanctions against Tornado Cash.

The court made the following statements in its decision:

“The district court decision was annulled and the case was remanded to the district court for further proceedings in accordance with the opinion of the court.”

This decision of the court is seen as an important legal turning point for privacy technologies. However, this legal victory of Tornado Cash does not offer a clear solution for the developers of the protocol. While Pertsev’s situation remains unclear, this change in the courts’ approach to privacy technologies is being watched carefully.

Pertsev argued at his hearing in March 2024 that he could not be held responsible for users using the protocol for illegal transactions. However, the court rejected this defense and ruled that Tornado Cash’s founders should have taken more precautions to prevent misuse of the protocol.

The court stated that Pertsev, as well as other Tornado Cash developers, could establish more control mechanisms over such protocols. The decision is expected to put great pressure on teams developing similar technologies.

Tornado Cash users appealed to the court, objecting to OFAC’s sanctions. In this appeal, filed on November 26, 2024, six users argued that OFAC had exceeded its legal authority.

Users stated that Tornado Cash’s “smart contracts” cannot be considered property of any foreign person or entity. Therefore, they claimed that blacklisting the protocol was illegal.

The plaintiffs also pointed out that blockchain transactions are traceable, emphasizing the need for technologies that will protect users’ privacy. This objection was found justified by the court and the sanctions were cancelled.

The removal of sanctions against Tornado Cash is seen as an important turning point for the future of privacy technologies in the blockchain ecosystem. This is a promising development not only for Tornado Cash, but also for other teams developing similar privacy protocols.

Matthew Niemerg, co-founder and president of AlephZero, stated that it is critical that privacy technologies are developed and delivered in accordance with the legal framework. Niemerg stated that such protocols should both protect user privacy and ensure legal compliance.

The court’s lifting of Tornado Cash sanctions could encourage innovation in technologies that prioritize users’ privacy. However, it will continue to be a necessity for developers to create stronger auditing mechanisms to prevent misuse of such protocols.
