New Allegations in Wu-Tang Album Case Against Martin Shkreli

PleasrDAO alleges that Martin Shkreli failed to hand over all available copies of the Wu-Tang Clan album, of which only one copy exists, and alleges that Shkreli publicly bragged about giving copies of that album to “50 different girls.”

Accusing Martin Shkreli of diminishing the value of the Wu-Tang Clan album by keeping a single copy of it, PleasrDAO demanded a more comprehensive search, claiming that Shkreli did not “fully” comply with the court order.

PleasrDAO — the group that owns the sole physical copy of Wu-Tang’s Once Upon a Time in Shaolin — said in a letter to New York federal court on Sept. 6 that Shkreli’s claims that he delivered all copies of the album were “dubious.” and requested a more in-depth search and seizure process.

After the court ordered him to turn over all copies and verify that no other copies of the album existed, Shkreli filed a sworn statement on August 26, saying he found 15 files of the album saved on Microsoft One Drive.

Shkreli testified that he searched his “devices, electronic accounts, and other personal items,” but PleasrDAO suggested there may be locations where other copies of the album were stored. “Mr. Shkreli indicates that additional copies may be located in the ‘storage’ facilities that housed his personal belongings during his time in prison, but does not provide specific information about what prevented him from searching all of these facilities,” PleasrDAO wrote.

Wu-Tang Clan’s album was recorded between 2007 and 2013 and has at least 31 tracks spanning two discs, according to a track listing released by PleasrDAO in April.

PleasrDAO alleged that Shkreli declared that he had “sequestered and delivered” audio files for only 15 tracks, but publicly bragged about distributing copies of the album and stored additional copies of the album “in vaults around the world.”

The band responded with Shkreli saying in a public statement, “Dude, I burned the album and sent it to, well, 50 different girls, you know that right?” he claimed.

The DAO purchased the album from the US Department of Justice in 2021 for $4.75 million. The album was seized by the government after Shkreli was convicted of securities fraud in 2018.

The DAO is selling partial ownership of the album via non-fungible tokens (NFT).

The DAO, which filed a lawsuit against Shkreli in June, alleged that Shkreli retained copies of the album. The DAO demands that the album’s purchase must remain a single copy and that a judge order Shkreli’s alleged copies to be permanently seized and Shkreli barred from any financial use of the album.

Shkreli, however, argued that the copies in question were created under the purchase agreement made when he first purchased the album, and therefore the copies were not included in the seizure and he still had the right to use them.
