Heather Morgan, Who Pleaded Guilty to Bitfinex Theft, Wants a Second Chance

Heather Morgan argued that she should not receive further prison time for her role in the laundering of 120,000 Bitcoins stolen from Bitfinex.

Rapper Heather Morgan, known as Razzlekhan, argued that she should not receive further prison time for her role in laundering some of the 120,000 Bitcoins stolen from Bitfinex by her husband, Ilya Lichtenstein.

“Ms. Morgan has proven that she deserves a second chance, and we respectfully request that this Court give her that chance and limit her sentence to time served,” Morgan’s attorneys wrote in their Oct. 31 filing in Washington, D.C. federal court.

Morgan has been recovering from his week-long pretrial detention, had COVID-19, and has fully complied with the conditions of his detention since his release in mid-February 2022, his lawyers said.

Morgan was sentenced to ten years in prison after pleading guilty to money laundering and fraud in an August 2023 deal for helping launder 120,000 Bitcoins stolen from Bitfinex by her husband, Ilya Lichtenstein, now worth about $8.2 billion. He faced punishment.

Last month, US prosecutors sought a lenient prison sentence of 18 months because of the “substantial assistance” Morgan provided. They argued that Morgan was a “lesser participant” than Lichtenstein and spent only a “small fraction” of the amount the pair stole.

“She was dragged into the middle of a serious criminal plot without her consent and undoubtedly felt obliged to support it out of loyalty to her husband and desire to protect their lives,” prosecutors said.

Morgan’s lawyers stated that he did not plan or intend the crime in this case and that his wife found out about the hack three years after she carried it out; But they said he admitted to committing a serious crime and expressed deep remorse.

Some people have noticed that Morgan has been attending crypto-related conferences this year; His lawyers stated that he had been working and “mature” since his release and that he tried to distance himself from rapper Razzlekhan as a “completely different character”.

In a plea deal filed in August 2023, Morgan’s husband, Lichtenstein, admitted to stealing 120,000 Bitcoin from Bitfinex and enlisting his wife’s help in using crypto mixers and other privacy services to cover up nearly 25,000 BTC.

In a filing last month, US prosecutors told the court that Lichtenstein’s 20-year prison sentence should be reduced to five years because his “significant assistance” had benefited many investigations.

Even so, prosecutors said Lichtenstein should be sentenced longer than Morgan because he developed the plan for months and tested it by stealing $200,000 from another exchange.

Morgan will be sentenced on November 15, and Lichtenstein will be sentenced the day before, on November 14.
